Independent Contractor vs. Employee: Which do I choose?

An individual working for a corporation should clearly define in an agreement whether the employee is an employee or independent contractor. An employee owes certain fidiciary duties that an independent contract does not. However, there are certain elements by law that decide whether an individual is an employee or independent contractor for tax and liability purposes.
